This consignment agreement (this “Agreement”) is made effective on (Date) _________________________________ between (Consignor’s full name) ________________________________________________ (“Consignor”) and L.O.V.E. Consignment, of 1225 Military Road Suite B, Benton, AR, 72015 (“Consignee”).
 
The parties agree as follows:

I. Right to Sell. The Consignor agrees to deliver to the Consignee items for sale on consignment as described in your email with your list of items. The Consignor owns items. In accordance to this agreement, the Consignor grants the Consignee an exclusive right to sell the items under the terms of this agreement. The Consignee agrees to devote its best efforts to the sale of the items. II. Consignment Terms. The consignment period will begin on the Start Date that is listed on the Items List Document and conclude 150 days later (End Date). Consignor can retrieve unsold items within 10 days after the End Date. Consignor can have items donated to charity.
III. Pricing and Sale. All sale prices and terms of sale shall be determined by the Consignee. Price drops could start on items after 60 days, starting with 10% off and increasing every 30 days.
IV. Payment. The sale proceeds will be split, with 40% going to the Consignor and 60% retained by the Consignee. Payments to Consignor will be made by the 5th of each month for items sold during the previous month.
V. Loss or Damage. Consignee shall not be responsible for loss or damage to items except in the case of negligence. 
VI. Return of Unsold Items. Unsold items not retrieved by the Consignor within the period stated above will become the property of the Consignee and may be donated, destroyed, or otherwise disposed of at the Consignee’s discretion
VII. Web Access. The Consignor has the option to view their daily sales from the Consignee’s web application. There will be a $2/month fee to use this application. The Consignor will need to provide the following on the web application:

• (a.) Full Name

• (b.) E-mail Address

• (c.) Banking information

VIII. Governing Law. This agreement is governed by the laws of the State of Arkansas.
IX. Entire Agreement. This agreement contains all terms agreed upon by the parties and supersedes all other agreements, understandings, and communications between the parties.
